1. Acceptance of Terms

By accessing or using the SiteActive platform (app.siteactive.co.za or siteactive.co.za), you confirm that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, you may not access or use the platform. These terms apply to all users, organisations, and accounts.

2. Platform Description

SiteActive is a compliance management Software-as-a-Service (SaaS) tool provided by SITEACTIVE (Pty) Ltd. It does not constitute legal advice, compliance certification, regulatory underwriting, or a substitute for professionally qualified safety officers or legal practitioners. All AI-generated documents are drafts requiring review and sign-off by the relevant appointed responsible person before use or submission.

3. User Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials. Organisations are responsible for all activity occurring under their subscribed accounts. You must notify us immediately at info@siteactive.co.za of any unauthorised access or security breach. We reserve the right to suspend accounts where security is compromised.

4. Acceptable Use

You may not use SiteActive to:

  • Upload false, fraudulent, or fabricated compliance documents
  • Misrepresent your compliance standing to clients, auditors, or third parties
  • Attempt to manipulate compliance scores or circumvent enforcement logic
  • Share account access beyond your subscribed user count
  • Use the platform for any unlawful purpose under South African law

5. Data Protection & POPIA

SiteActive processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Employee data uploaded to the platform is encrypted at AES-256 standard, stored within compliant infrastructure, and accessed only by authorised users within your organisation. We do not sell, transfer, or share your data with third parties without explicit consent, except where required by law. For data subject access requests, corrections, or deletions, contact privacy@siteactive.co.za. Our Information Officer is registered with the Information Regulator as required under POPIA.

6. AI-Generated Content

Documents, risk assessments, method statements, and other content generated by SiteActive’s AI engine are provided as professional drafts only. They do not constitute certified compliance outputs, legally binding documents, or regulatory submissions without independent professional review and sign-off by a suitably qualified appointed person. SiteActive accepts no liability for reliance on AI-generated content without such review.

7. Subscription & Billing

Subscriptions are billed monthly or annually via PayFast or such other payment processors as may be notified. Annual subscriptions are non-refundable after the 14-day trial window. Month-to-month subscriptions may be cancelled at any time; access is retained until the end of the billing period. Following cancellation or downgrade, your compliance data remains available for export for 30 days, after which it may be archived. We reserve the right to adjust pricing with 30 days advance notice.

8. Service Availability

SiteActive targets 99.5% platform uptime. Planned maintenance windows will be communicated in advance via the platform. We are not liable for losses, compliance gaps, or regulatory consequences arising from temporary unavailability of the platform, force majeure events, or third-party infrastructure failures beyond our reasonable control.

9. Intellectual Property

The SiteActive platform, brand, algorithms, scoring models, and all derivative works are the intellectual property of SITEACTIVE (Pty) Ltd. All rights reserved. Your compliance data, documents, and organisational information remain your property. We claim no ownership rights over content you upload or create within the platform. You grant us a limited licence to process and store your data solely for the purpose of providing the service.

10. Limitation of Liability

To the maximum extent permitted by applicable South African law, SITEACTIVE (Pty) Ltd and SiteActive shall not be liable for any indirect, incidental, special, or consequential damages arising from or relating to your use of the platform. Our total aggregate liability for any claim shall not exceed the amount you paid us in the three months immediately preceding the event giving rise to the claim. Nothing in these terms excludes liability for gross negligence or wilful misconduct.

11. Indemnification

You agree to indemnify and hold harmless SITEACTIVE (Pty) Ltd, its directors, officers, and employees against any claims, losses, damages, or expenses (including legal costs) arising from your use of the platform, your uploaded content, your violation of these terms, or your misrepresentation of compliance standing to any third party.

12. Third-Party Services

SiteActive integrates with or references third-party services including payment processors, email providers, legal partner networks, and insurance partners. We are not responsible for the availability, accuracy, or conduct of third-party services. Your use of partner services is subject to their own terms and conditions.

13. Changes to Terms

We may update these terms from time to time. Material changes will be communicated with at least 30 days’ notice via the platform or the email address associated with your account. Continued use of the platform following the notice period constitutes acceptance of the updated terms.

14. Governing Law & Jurisdiction

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from or in connection with these terms or your use of the platform shall be submitted to the exclusive jurisdiction of the High Court of South Africa, KwaZulu-Natal Local Division, Durban. You consent to this jurisdiction and waive any objection to proceedings in that court.
